Yer da's on the cans again :
If they scrapped juries we’d have judges just throwing people in jail to hit targets

This is unfortunately a really uneducated argument. Trial by jury is not something we should ever get rid of— the problem is austerity, the solution is not to do away with democracy, the solution is to fix austerity and fund the courts properly.

Not sure you’d agree but it sounds quite similar to people who want to abandon the NHS for private healthcare because it has been (on top of plenty of its own issues) deliberately sabotaged by those who would benefit from privatisation. Refuse to modernise -> frustrate the public -> remove a right people previously had, as if its for their own good. Not even remotely as familiar with the legal system though, so IDK if the parallel holds up

It’s regrettable that you anecdotally had a negative experience, but there is almost no one who works in criminal law day in, day out that would agree with you and that should tell you all that you need to know.

removing juries won’t serve the backlog, we don’t have enough judges, lawyers, court staff, court space etc. when you’re sat there waiting there’s other things going on in the background which take up time and even if you said ‘ok lets just have it in front of a judge’, you’d still get these delays

i agree. however, the main issue imo is that jury trials are a major and longstanding part of our constitutional setup. there needs to be political consensus on such a change, especially if it's just for 'efficiency' purposes.

Naaahhh in principle it’s got to stay. There’s got to be other fixes to make things more efficient, educate more people and all

We need checks and balances, and so you get to waste a little time. The issue isn’t jury trials it’s the drastic underfunding of the whole legal system, withdrawing legal aid, and having a single decision behind closed doors are problems. Fund it properly, don’t compromise.

cases around protestors tend to win over the jury, them wanting to scrap juries was verrrrry linked to the pal act proscription mess.

They intentionally make juries inefficient so when they take them away less people complain. Same as the NHS.

Would smaller juries be viable for some cases? I remember hearing about people going on jury duty and ending up not being needed the whole time so just went out for lunch and headed home early, surely we can use those to make up smaller juries, or even have them review things

Yes let’s let the rich, old, white, male judges make the sole decision on if someone should be in jail or not, that sounds like a great idea

Numerous studies show that judges are biased against people of colour and that juries act as a filter for prejudice

I've been in and around the justice system almost my entire career and have been part of a jury - some people do not understand the law, cannot differentiate between fact and conjunction and when it comes to anything more complicated than a straight assault, people switch off, follow the crowd or inject stereotypes into the proceedings. Not to mention the musical lottery you're in if your crown court is in a area with poor educational attainment or lower socioeconomic indicators, are you really getting the same level of justice as a jury in a well educated affluent area? For some offences, I honestly think a professional jury should be employed or be made up of a judge, lawyers and magistrates

i have many thoughts and feelings on this subject but i will say that it is not helpful that they announced cutting jury trials EXCEPT for the most serious offences, therefore implying that juries are actually preferable (hence they should be kept in most serious cases) as opposed to making clear that the benefits the jury system provides do not outweigh the identified problems

I agree. Juries are inefficient and frankly ill qualified to make life changing legal decisions (compared to say 3 independent legal experts).

This feels like it’s based on your one time serving jury duty and not a wider berth of experience. I am a lawyer and I can safely say that jury’s perform a really important service. For example, if it were only down to the judges (most of which come through rich privileged backgrounds who have poor understanding of people from lower classes) we would find that a lot of unfair decisions are made.

Terrible take. Jury trial is a moral and justice issue, a human right, and bad logistics isn't a reason to go against morals and human rights. I sat in a jury service waiting room 7 hours a day for 2 weeks, that's the cost of democracy and fair rights.
