Honestly, I know it’s hard, but that’s not your baby. So you give the baby to his biological parents and then you sue the clinic for a lot of money. You don’t get your baby, but you helped another family and you did the right thing

If the birth mom had agreed to surrogacy, and then changed her mind, then I could see a court making this call. But if a mom asked for her own embryos and the fertility center and everyone involved believed she was implanted with her own embryos... the children that are produced should be incontestably hers, regardless of genetic testing. The actual genetic parents can sue the clinic for improper handling of their embryos, and the loss it caused them. But they should not be allowed to forcibly confiscate a child that another woman carried, birthed, and raised, believing it to be her baby from day one.
